Terms of Service

Welcome to DealScout (a DBA of Quanta Plus Analytics, LLC). This Terms of Service Agreement ("Agreement") outlines the terms and conditions governing your access to and use of products and services provided by Quanta Plus Analytics, LLC, dba DealScout ("we," "us," or "our"). By accessing or purchasing our products and services, you ("you," "user," or "Buyer") agree to comply with this Agreement.

1. Definitions

• DealScout: Quanta Plus Analytics, LLC
• Buyer: User or entity purchasing products/services
• Data: Enhanced public record information provided
• License Term: Specified period of licensed access
• Products and Services: All provided Data, Information, platforms, and related offerings

2. License & Usage

License Grant

We grant you a limited, non-transferable license to access our Data for internal business use during your active License Term.

Acceptable Use

You agree:

• To comply with all applicable laws
• Not to share, resell, or sublicense our Data
• Not to use our Data to resell the data itself to third parties
• Not to engage in disruptive or illegal activities
• Not to violate privacy or rights of third parties

Restrictions

We reserve the right to audit compliance with this Agreement. Non-compliance may result in license termination without refund.

3. Intellectual Property

All trademarks, logos, and intellectual property related to DealScout remain exclusively ours. Use of these is prohibited without explicit written consent.

4. Payments & Billing

• Pricing is subject to change but will not affect existing active licenses
• All fees are due according to the terms specified at the time of purchase
• Payment processing is handled securely through Stripe

5. Refund Policy

All subscription payments are non-refundable. Once you subscribe to a listing, you immediately gain access to the data through your dashboard.

• You may cancel your subscription at any time through your account settings
• Cancellation will prevent future billing, but the payment for the initially purchased subscription period will not be refunded
• Refunds may be considered only in exceptional circumstances at the owner's sole discretion

6. Privacy, Data Protection, and Marketing

By using our products, you agree to our Privacy Policy, including optional email marketing consent. You acknowledge marketing consent is not a purchase condition.

You must independently ensure compliance with applicable marketing laws (e.g., TCPA, CAN-SPAM Act). We accept no liability for violations arising from your use of Data provided.

7. Termination & Account Management

Either party may terminate this Agreement at any time:

• We may terminate without notice for violations of this Agreement, and no refunds will be provided for violators
• You may cancel your subscription at any time through your account settings

8. Third-Party Services

We provide references to third-party services but are not responsible for their quality or reliability. You are responsible for reviewing and complying with third-party terms and privacy policies.

9. Indemnification & Liability

You agree to indemnify us against any claims, losses, or damages arising from:

• Your use of our products/services
• Non-compliance with this Agreement or applicable laws

Limitation of Liability

Our liability for damages related to this Agreement is limited to fees paid within the past 12 months. We are not liable for indirect, incidental, special, or consequential damages.

10. Dispute Resolution

Disputes will be governed by the laws of the State of Wyoming. You agree to resolve disputes exclusively through binding arbitration, waiving rights to participate in class-action lawsuits.

11. Miscellaneous

• Severability: Invalid provisions will not affect remaining terms
• Assignment: You may not transfer rights without our written consent
• Survival: Provisions regarding intellectual property, liability, indemnification, and data protection survive termination
• Updates: We may modify this Agreement at any time. Updates will be made available via our website. Continued use constitutes consent to changes
